Però senza questo correttivo imprescindibile, la maschia libertà, lasciata a sé stessa si degrada e produce non solo diseguaglianza ma solitudini estreme, che portano all’emarginazione e al solipsismo.

Su questo pericolo della libertà Ainis si sofferma a lungo nel suo recente Il regno dell’Uroboro, uscito all’inizio dell’inverno per la milanese La nave di Teseo, con cui il costituzionalista si inserisce in maniera brillante nel filone della critica al mondo del web e in particolare dei social media che ha come capofila il sociologo Evgenij Morozov e conta vari esponenti di primo piano in Italia, tra cui l’informatico Domenico Talia.

Nel caso del costituzionalista siciliano, lo sguardo del giurista aggiunge dei dettagli in più a questa lettura critica, la rende meno apocalittica e più orientata agli aspetti salienti della vita delle persone comuni.

La rete genera anomia. Forse lo fa sin dagli anni ’90, quando iniziarono gli allarmi degli addetti ai lavori sulla cosiddetta cyberdipendenza. Ma per Ainis il punto di non ritorno risale a circa dieci anni fa.

Il primo aspetto del problema denunciato da Ainis riguarda la privacy che le tecniche di profilazione messe a punto dai big della Silicon Valley, su cui il giurista fa il punto e denuncia anche l’imprecisione forte (ai limiti dell’approssimazione) dei rimedi approntati dalle istituzioni politiche, incluso il Gdpr.

Il secondo aspetto, invece, riguarda la solitudine intellettuale come effetto riflesso della profilazione: nel momento in cui le notizie e le informazioni non sono più selezionate sulla base di criteri automatici e tendenzialmente oggettivi – ad esempio, quelli utilizzati da una redazione giornalistica di passabile qualità – ma sulla scorta dei gusti e delle preferenze espresse dai singoli navigatori, viene meno il confronto e lo scambio delle idee.

Questa parabola ha delle ricadute pesantissime proprio sull’esercizio dei diritti di cittadinanza, che Ainis descrive in un altro, efficacissimo passaggio, che vale la pena citare per intero:

«La rete diventa un po’ come uno specchio, una superficie riflettente dove non si moltiplica l’immagine del mondo bensì quella dei singoli individui, o al limite delle comunità parziali, come i seguaci d’una setta. Le informazioni circolano, ma a compartimenti stagni, in circuiti separati. Da qui il confirmation bias, ovvero l’influenza delle nostre aspettative sui fatti rispetto al mondo in cui li interpretiamo: uno schema mentale antico quanto l’uomo che però l’informatica eleva alla massima potenza. Da qui, in conseguenza, il fenomeno della post truth […]. In questo caso la “post verità” esprime l’irrilevanza dei fatti nella formazione dei processi cognitivi, come la negazione del riscaldamento globale o le false informazioni che hanno determinato Brexit. Da qui, infine, una neonata disciplina: l’agnatologia, ossia lo studio dell’ignoranza attraverso dati scientifici fuorvianti».

Su questi punti ruota tutta l’analisi contenuta ne Il regno dell’Uroboro, condotta tra l’altro con toni e riflessioni che a tratti ricordano assai da vicino Baumann.

Certo, la critica al web non è tutta oro colato. Ma per fortuna Ainis si tiene ben al di qua dal confine oltrepassato il quale si finisce tra gli apocalittici della rete. Il taglio chirurgico del giurista sa distinguere benissimo tra la critica all’atomizzazione sociale indotta dalla rete e la tutela dell’individuo. Perciò, quando denuncia i rischi dovuti alla profilazione e alla gestione dei big data attraverso tecnologie prossime all’intelligenza artificiale lo fa con la consapevolezza di chi tenta di difendere l’individuo, inteso nella pienezza dei suoi diritti di cittadino, che altrimenti è «nudo davanti ai potentati» e non con retropensieri autoritari.

Proprio questa lettura evidenzia, attraverso quello che Ainis definisce paradosso della privacy, la torsione della tutela delle libertà, che è fortissima davanti alle istituzioni politiche, che violano la privacy per tutelare tutti, ma diventa minima davanti ai colossi dell’informatica (i potentati, appunto), apolidi e perciò politicamente irresponsabili.

Questo capovolgimento di prospettive, al pari dell’ignoranza indotta e all’abuso della post verità, porta con sé altre conseguenze: la distruzione dei corpi intermedi e il nuovo cesarismo politico creato dalla comunicazione social (che Ainis con molta efficacia definisce capocrazia) la continua scomposizione-ricomposizione delle comunità digitali, che alla fine isola ancor di più gli individui e li assoggetta ai capricci del mercato digitale impazzito.

Conclude, al riguardo Ainis alla fine dell’Introduzione al suo pamphlet: «È infatti questa la nuova condizione umana: una solitudine di massa, come se il gomitolo delle nostre relazioni si fosse riavvolto tutt’a un tratto, lasciandoci senza un filo che ci connetta agli altri. E lasciandoci, perciò, senza democrazia, dato che quest’ultima si nutre del confronto tra punti di vista eterogenei. Quale regime potrà sostituirla? Il regno dell’Uroboro, serpente che si morde la coda, formando un cerchio chiuso. Il regno dell’autoreferenza». C’è davvero altro da aggiungere?
