Il Comune di Motta Santa Lucia, meno di mille anime nella parte catanzarese del Savuto e paese natale di Villella, ha intentato una causa nel 2012 al Museo Lombroso per riottenere le spoglie del concittadino, ignorato, a dispetto della divulgazione storiografica, fino al 2009, anno della riapertura del Museo.

Il giudice Gustavo Danise del Tribunale di Lamezia Terme emette il 3 ottobre 2012 un’ordinanza con cui dà ragione al Comune di Motta e intima al Museo la restituzione del teschio. La tempistica di Danise è da record, considerata la media dei Fori calabresi: il processo, infatti, era partito pochi mesi prima, come si desume tra l’altro dalla data della delibera (5 aprile 2012) con cui il Comune aveva incaricato l’avvocata Giovanna Gaetano del Foro di Lamezia di difendere l’amministrazione.

A questo punto è d’obbligo un commento: magari i Tribunali fossero altrettanto rapidi a giudicare sui vivi.

Il processo è ripartito, anche tra l’incredulità dei magistrati, davanti alla Corte d’Appello di Catanzaro, dove si è verificato un colpo di scena alla fine dello scorso settembre: tra i due litiganti è spuntato un terzo pretendente del cranio. Si tratta di Pietro Esposito, discendente diretto del presunto brigante. Esposito, rappresentato in giudizio dall’avvocata Letizia Di Valeriano del Foro di Tivoli, è intervenuto nel processo sulla base di una delega per atto notarile di sua madre, Anna Rosaria Bevacqua, impossibilitata a partecipare al processo per ragioni d’età e di salute.

Questo intervento, sulla cui fattibilità la Corte d’Appello è chiamata a pronunciarsi, rimescola non poco le carte. Ma andiamo avanti.

Com’è nato questo processo e, soprattutto cosa lo ha motivato?

Del ruolo di Villella (o meglio, del suo cranio) nel pensiero lombrosiano si sapeva già. Lo scienziato veronese scambiò, nel 1871, il pastore calabrese per un brigante e credette di aver trovato nel suo cranio una prova importante per la sua teoria secondo la quale la tendenza a delinquere sarebbe innata in vari individui e sarebbe riconoscibile da alcune caratteristiche somatiche. Nel caso di Villella, da una malformazione del cranio: la cosiddetta fossetta occipitale mediana. Il teschio del mottese è uno dei pochi resti umani correttamente catalogati da Lombroso, che ne aveva scritto a più riprese.

Non si sa se lo studioso veronese abbia scritto brigante perché credeva davvero che Villella fosse un brigante o, invece, abbia usato il termine in maniera generica, come sinonimo di delinquente, errore non infrequente nella letteratura dell’epoca.

Fatto sta che, nel 2014, Maria Teresa Milicia, una ricercatrice dell’Università di Padova di origine calabrese, ha compiuto una laboriosa ricerca d’archivio, da cui risulta che Villella, in effetti, non fosse un brigante, bensì un pastore arrestato e morto in carcere per reati contro il patrimonio (e non per brigantaggio).

Ma la macchina dei sudisti era già abbondantemente in moto, tanto più che avevano vinto il primo grado.

A dare l’avvio al tutto era stata una campagna piuttosto martellante della Gazzetta del Mezzogiorno cominciata a fine 2009. Il giornale pugliese, diretto fino all’anno prima da Lino Patruno, fiancheggiatore dei gruppi d’ispirazione neoborbonica, considerava, tra l’altro senza prove, il Museo torinese una sorta di fossa comune di resti dei briganti.

Alla Gazzetta pian piano si sono uniti i media calabresi, in cui ha giocato, tra gli altri, un ruolo importante Romano Pitaro, addetto stampa della Regione Calabria e firma, all’epoca, della Gazzetta del Sud.

Per i neoborbonici, che nel 2010 avevano costituito il Comitato tecnico scientifico “no Lombroso” era un buon punto di partenza. A cui si aggiungeva il fiancheggiamento della classe politica calabrese, tra cui il deputato Roberto Occhiuto e il consigliere regionale Orlandino Greco.

La truppa, insomma c’era. E Domenico Iannantuoni, il presidente del Comitato, è riuscito a manovrare alla grande, dimostrando non poche doti comunicative.

Fondamentale, per lui, è stato l’incontro con Amedeo Colacino, sindaco di Motta Santa Lucia e avvocato del Foro di Lamezia Terme. Colacino era stato informato sul Museo Lombroso (e dell’esistenza di Villella) da Gennaro De Crescenzo, leader del Movimento neoborbonico. Sulla spinta della folgorazione sudista e di presupposti politici (la vicinanza ad Orlandino Greco, all’epoca in Mpa e ora consigliere regionale), Colacino aderisce al Comitato “no Lombroso”, si lega a Iannantuoni e va alla carica. Iannantuoni, infatti, aveva tentato in più modi – denunce per vilipendio di cadavere alla Procura della Repubblica, appelli alle autorità ecclesiastiche e a quelle politiche e amministrative – di far chiudere il Museo, considerato una sorta di tempio becero del razzismo antimeridionale. Non a caso, Anna Caterina Egeo, moglie e socia di studio di Colacino, è l’avvocata del Comitato, intervenuto nel processo a fianco del Comune. C’è da credere che anche lei, come la Gaetano, si sia dedicata gratis alla causa identitaria dei mottesi (o di Colacino).

Il tentativo di adire il Tribunale di Lamezia, in prima battuta va benissimo: Danise emette un’ordinanza che sembra soddisfare tutte le pretese dei ricorrenti, soprattutto nel punto in cui afferma che «il buon nome e l’immagine morale costituiscono diritti soggettivi da tempo riconosciuti anche agli Enti Local (cfr. Cass., sent. n. 5242/12; n. 11353/10); questo diritto al riscatto morale costituisce il fondamento della legittimazione e dell’interesse ad agire in capo al Comune di Santa Lucia, che potrebbe lucrare prestigio sociale dal recupero delle ossa di un personaggio che tanta importanza ha rivestito per l’antropologia criminale e che oggi è stato riabilitato».

Al che, dal solo punto di vista storico-scientifico, si può opporre qualche obiezione: Villella non è stato riabilitato semplicemente perché era caduto nell’oblio, persino dei suoi compaesani. Non fu condannato da una corte speciale istituita in base alla legge Pica, che regolamentava la lotta al brigantaggio, ma da una Corte ordinaria, che gli attribuì reati comuni. Nessuno, inoltre, ha mai considerato Motta, peraltro quasi per niente menzionata negli atti storici sul brigantaggio, una culla di delinquenti nati.

Fuori luogo appare inoltre il paragone, fatto dal giudice Danise nella stessa ordinanza, con il caso Tortora. Il giudice, in sintesi, scrive che tutelare il diritto del Museo torinese a trattenere i resti del defunto pastore mottese per dimostrare gli errori della scienza equivarrebbe a trattenere in carcere una persone ingiustamente detenuta per dimostrare gli errori dell’autorità giudiziaria… Il passaggio si commenta da sé, visto che è sbagliato paragonare un’esigenza storico-scientifica a una problematica giudiziaria.

Ma torniamo al processo: dopo l’intervento dell’erede sembra che le macchine si siano fermate. Dall’Università di Torino non traspare nulla, mentre il Comitato “No Lombroso”, soprattutto il suo presidente, continua la sua attività. Certo, le cose sono piuttosto cambiate dal 2012: l’unico motivo rimasto per contrastare il Museo sembra quello umanitario.

La Corte d’Appello ancora non ha deciso. Tuttavia, ciò non ha frenato né i membri del Comitato dall’insultare su Facebook chi non la pensa come loro (ne hanno fatto le spese la Milicia, un docente, anch’esso di origine calabrese, dell’Università di Torino e qualche giornalista non allineato al trend sudista) né Colacino dall’esternare e dal minacciare querele. L’ultimo bersaglio della polemica è stato Esposito, accusato in pubblico dal sindaco di Motta di essersi venduto al Museo sulla base di prove difficilmente utilizzabili in sede processuale: l’asserita registrazione di una conversazione telefonica privata senza aver preavvisato l’interlocutore.

Resta il fatto che la battaglia del Comitato è finita in riflusso, coperta dall’iniziativa di alcuni esponenti del Movimento 5Stelle che hanno chiesto l’istituzione di una giornata della memoria per i martiri del Risorgimento. Una cosa facile e meno rischiosa di contese giudiziarie partite in quarta e arrestatesi nella farragine degli uffici giudiziari.
